Is Giving Strangers A Lift An Offence In India?

Chillax, chillax! We know, sirf Dilliwalo ki nahi hai, humaare desh ke har naagrik ka dil kuch zyada hi bada hai when it comes to giving a lift to strangers, especially women, aged, and children. But to answer if giving strangers a lift is an offence in India–you got to continue reading then.

If the police catch you giving a lift to an unknown, you are surely going to be fined, as this resident of Navi Mumbai has learned:

1. On June 18, Nitin Nair, 32, was captured and sent three foreigners, including a senior citizen (all were stuck in the rain), to a raised shift. Mumbai Mirror announced that he was fined Rs 1500 for his “good deed”.

2. The cops were already licenced, leading to it.

3. A group of people (including an elderly man) was found stranded and provided a lift to Navi Mumbai resident Nitin Nair. He was arrested in an act by the traffic cops and punished for the same.

4. “The police officer then began to write a receipt and asked me to give my licence to it,” Nair said in an email. When asked why? He said, “Giving unknown people a lift is illegal.”

5. Section 66 (1) read in 192 (a) of the Motor Vehicle Act of 1988 stipulates: no matter how f the passenger is, no owner of a motor vehicle shall use the motor vehicle as a carriage vehicle (except under conditions of a permit issued by a Provincial or State Transport Authority)

6. Even after his licence was revoked (a chalan was granted), his co-passengers were not supposed to use any other vehicle.

7. After the traffic cop incident, Nair nevertheless, actually dropped them at their destination.

8. His co-person was not invited to take another mode of travel, but his licence was seized (he was granted a chalan).

Nair went to the police department and was granted his licence the next day. Nonetheless, a receipt was ordered from the court before he was given his licence back.

“I was brought to court at 10AM on June 22. I was there at 9:30, and I was sitting in the courtyard hallway till 1PM. I had to wait there as if I had a suspect, with prosecutors and others arguing their respective lawsuits in a courtroom full of lawyers.”
